Bottom rail location

I have someone replacing the steps, handrails and posts on my deck. They cut the treads to be flush with the stringers. The stringers are mounted inside the 6x6 posts. The bottom rail is mounted 1.5 inches from the outside of the post, leaving a 3 inch gap. Is this acceptable? I can't find anything that addresses this, only that a 6" sphere must not be able to pass through.
