I have two windows covered with a screen sitting 4-5 inches above my deck. My question is do I need to replace these windows with glass tempered ones eventhough I don't see it as a safety hazard issue?

I hope I understand your question properly. If these are patio sliding doors leading out to a deck you do not have to ask for them to be tempered - although they may be. I don't know what the manufacturer specifications are.
The patio glass door is made for its intended use as a patio door and should meet all requirements for that use.
However, when glass is used as a railing panel you must use tempered glass and there are specifications for this glass in the various building codes.
